It also describes the choices available to you regarding our use of your personal information and how you can contact us.

By using or accessing the Website, you signify your agreement to be bound by this Privacy Policy. IF YOU DO NOT AGREE TO THIS PRIVACY POLICY YOU MAY NOT ACCESS OR OTHERWISE USE THE WEBSITE.

Personally Identifiable Information that we collect:

We do not collect personally identifiable information from you on the Website unless you voluntarily provide it to us, such as by contacting us about an Event, inquiring about a job or otherwise choosing to share your personally identifiable information with us. The personally identifiable information which you may provide to us could include your name, email address, physical address and other personal information including your resume and associated information.

An individual’s desire to “optout” of receiving marketing or other information from a client will be handled in accordance with the applicable client’s privacy policy and should be directed to that client or sponsor of the specific Event. Ultimately, we are not responsible for data collected in connection with Events when such data is in the applicable client’s possession.

They are not authorized by us to use the information for their own benefit.
  • We may disclose personally identifiable information as required by law or legal process.
  • We may disclose personally identifiable information to investigate suspected fraud, harassment or other violations of any law, rule or regulation, or the terms or policies for the Website.
  • We may transfer your personally identifiable information in connection with the sale or merger of Optimist or the division responsible for the services with which your personally identifiable information is associated.
  • We may share your personally identifiable information if necessary to respond to your specific requests.

Visitors to any specific Event websites built for our clients may be given the option of providing contact information and other personally identifiable information, such as their name and email address. This information may be used by us to enter the visitor in a promotion, provide information, assess the needs of a business to determine suitable products and select and contact potential winners and other site visitors via phone, fax, email and paper mail.

When we receive, collect and process visitors’ personally identifiable information in connection with an Event, we may also require sensitive information, such as social security number or date of birth. Visitors may provide this information in a variety of methods, depending on the particular promotion. We only use this personally identifiable information to conduct the Event for the applicable client. We do not use the information for any other purpose. We maintain the information only for so long as necessary to verify and conduct the Event and to provide redundancy for our clients. We do not provide this information to any entity other than our client and others involved in the operation of the Event. Our clients’ privacy policies govern the use of this data and it remains their property.

We also process personally identifiable information we receive directly from our clients. In these cases, anyone who seeks access to or wishes to correct, amend, delete inaccurate data or withdraw consent of further contact should direct their query to the applicable client or sponsor. If the applicable client requests that we remove the data, we will respond to such request within 30 days.

It is our policy to retain client data for only as long as legally required or as requested by the applicable client, whichever is longer.

Non-personally identifiable information
We also collect certain information, not personally identifiable, on the Website and in connection with the Events. We may collect information about your computer configuration such as your browser type, operating system, or Internet service provider (“ISP”) domain name. We may also offer social signon services that allow you to register for a promotion using a thirdparty social networking site such as Facebook, YouTube, Instagram, Snapchat, Google, or Twitter. By using these services, you allow us to access the available information from your thirdparty social network profile, such as your name, age, gender, location, email address and list of friends. We may use this information to administer the technical and operational aspects of the Website or the applicable Event site, which may include using your Internet protocol (“IP”) address to help diagnose problems with our server. Your IP address may also be used to gather broad demographic information for aggregate use. This helps us to safeguard the program and diagnose problems in the operation of an Event.

The Website also uses Google Analytics, a web analytics service provided by Google, Inc. Google Analytics uses “cookies,” which are text files placed on your computer, to help the Website analyze how users use the Website. The information generated by the cookie about your use of the Website will be transmitted to and stored by Google on servers in the U.S.

If you are a visitor accessing the Website from an IP address located within the area of the member states of the European Union or other parties to the Agreement on the European Economic Area, in case IP-anonymization is activated on the Website, your IP address will be truncated within such area. In exceptional cases, the whole IP address will be first transferred to a Google server in the U.S. and truncated there. The IP-anonymization is active on the Website.

Google may use this information on behalf of us for the purpose of evaluating your use of the Website, compiling reports on Website activity for us, and providing us with other services relating to Website activity and internet usage. The IP-address that your browser conveys within the scope of Google Analytics will not be associated with any other data held by Google.

You may refuse the use of cookies by selecting the appropriate settings on your browser. However, please note that if you do this you may not be able to use the full functionality of the Website. You can also opt-out from being tracked by Google Analytics in the future by downloading and installing Google Analytics opt-out browser add-on for your current web browser:

We may also use cookies. We do not link the information we store in cookies to any personally identifiable information you submit while on the Website. We use both session ID cookies and persistent cookies. A session ID cookie expires when you close your browser. A session cookie might be used to track a user through a multipage registration process so they would not have to reenter information multiple times during the registration process. A persistent cookie remains on your hard drive for an extended period of time. For example, we may set a persistent cookie for a day to prevent a user from returning to a site and trying to enter a Sweepstakes more than once a day. You can remove persistent cookies by following directions provided in your Internet browser’s “help” directory. Each browser has a function which enables the user to disable cookies if so desired, but in that case, the participant may not be able to participate fully in a promotion, and certain aspects of the Website may be limited. We also gather certain information automatically and store it in log files. This information includes IP addresses, browser type, ISP, referring/exit pages, operating system, date/time stamp, and clickstream data. We use this information, which does not identify individual users, to analyze trends, track users’ movements and to gather demographic information about the user base of both our client’s promotions and the Website. We do not link this automatically collected data to personally identifiable information.

In addition to our own methods of anonymous data collection, our clients may use other types of tracking technologies. Unless otherwise stated, the use of cookies and other tracking technologies by our clients for the purpose of administering a promotion is not covered by this Privacy Policy. We do not have access or control over these cookies.

We will share your personal information with third parties only in the ways that are described in this Privacy Policy. We do not sell your personal information to third parties.

We may also disclose your personal information: (i) as required by law, such as to comply with a subpoena, or similar legal process; (ii) when we believe in good faith that disclosure is necessary to protect our rights, protect your safety or the safety of others, investigate fraud, or respond to a government request; and/or (iii) to any other third party with your prior consent to do so. If we are involved in a merger, acquisition, or sale of all or a portion of its assets, you will be notified via email and/or a prominent notice on the Website of any change in ownership or uses of your personal information, as well as any choices you may have regarding your personal information.

If you submit personal information to any of those sites, your information is governed by the applicable privacy policies. We encourage you to carefully read the privacy policy of any site you visit.

These Tools may collect your IP address, which page you are visiting on our site, and may set a cookie to enable the feature to function properly. Your California Privacy Rights (As provided by California Civil Code Section 1798.83)
A California resident who has provided personal information to a business with whom he/she has established a business relationship for personal, family, or household purposes (“California Customer”) is entitled to request information about whether the business has disclosed personal information to any third parties for the third parties’ direct marketing purposes. In general, if the business has made such a disclosure of personal information, upon receipt of a request by a California Customer, the business is required to provide a list of all third parties to whom personal information was disclosed in the preceding calendar year, as well as a list of the categories of personal information that were disclosed. However, a business is not legally required to provide the above described lists if the business adopts and discloses to the public (in its privacy policy) a policy of not disclosing the California Customer’s personal information to third parties for their direct marketing purposes unless the California Customer first affirmatively agrees to the disclosure, as long as the business maintains and discloses this policy. Rather, the business may comply with the law by notifying the California Customer of his or her right to prevent disclosure of personal information and providing a cost free means to exercise that right.
